PESHAWAR: In a letter written to Chief Justice of Pakistan (CJP) Qazi Faez Isa, Chief Justice of Peshawar High Court Muhammad Ibrahim Khan expressed concern over not considering the appointment of judges from Khyber Pakhtunkhwa province to the Supreme Court.
According to the details, Peshawar High Court Chief Justice Muhammad Ibrahim Khan said on Wednesday that he is writing this letter with a heavy heart and disappointment regarding discrimination and bias in the appointment of judges in the Supreme Court of Pakistan.
Justice Ibrahim said that your character reflects justice and merit, so I am placing this matter before you.
He said that there were four vacancies in the Supreme Court, but only one vacancy was made by appointing Justice Naeem Akhtar Afghan, a respected judge of the Balochistan High Court.
He said that when I came to know that only one judge in the Supreme Court and that too from your own province, despite four posts being vacant, I am happy for the appointment of my brother, Mr. Justice Naeem Akhtar Afghan, but why were my seniority, qualifications, and availability of posts in the Supreme Court not considered?
Justice Ibrahim said that he is the second-most senior Chief Justice among the Chief Justices of all the High Courts of Pakistan.
He said that I am also a member of the Judicial Commission of Pakistan and the Supreme Judicial Council of Pakistan (JCP). I expected to be shortlisted for appointment as a judge of the Supreme Court of Pakistan.
He wrote that if I had not been found fit to be appointed as a judge of the Supreme Court by the Judicial Commission of Pakistan, I would have gladly accepted the decision of the JCP.
In the letter, he expressed his belief that taxpayers, who pay our salaries, expect the vacancies to be filled immediately so that the court can function at full strength and deliver justice. It is mandatory to work diligently.
Despite four posts, the decision to appoint only one has disturbed me.
He said, “I am thinking about the possible reasons for not filling up the posts, but no logical and convincing reason came to mind.

Justice Ibrahim said he has served faithfully for 31 years, characterized by steadfastness, dedication, and numerous contributions that, in his opinion, have not only benefited the community but also upheld the high standards of the judiciary. Throughout my service, I have sought to embody the virtues of integrity, impartiality, and a steadfast commitment to justice, principles that I believe are inherently merit-based recognition and career advancement.
Will pave the way for development. I have been adjudicating high-profile cases amidst the awkward law and order situation and political crisis in my motherland, in which my commitment to uphold the rule of law and the supremacy of the Constitution has been unwavering.
He wrote that my dedication to serving the people and rooting out injustice in all its forms is a source of personal pride and a testament to my commitment to the values we hold so dear in our profession. Likewise, it is a distinction that I preserve my integrity before the Almighty Allah while recounting my 31-year judicial career and that I have done it to the best of my knowledge, within legal limits, and without any fear.
