ISLAMABAD: National Assembly Speaker Ayaz Sadiq submitted the names of parliamentarians for the Judicial Commission of Pakistan (JCP) — which will appoint judges to the Supreme Court, High Courts, and Federal Shariat Court — to the Supreme Court on Saturday.
In a letter written to the Secretary Supreme Judicial Commission, the NA Speaker nominated five members, including four lawmakers from the National Assembly and Senate, and one woman, the NA Secretariat said on Saturday.
Senator Farooq H. Naek and Senator Shibli Faraz have been nominated from the treasury and opposition benches in the Senate, respectively. Similarly, opposition leader Omar Ayub and Pakistan Muslim League-Nawaz (PML-N) MNA Sheikh Aftab have been nominated from the lower house.
The Speaker has nominated former senator Roshan Khorasani Brocha for the reserved women’s seat.
The NA spokesperson said the members of the government and opposition will have equal representation in the commission, adding that all the names were received by the Supreme Court.
A 13-member JCP will appoint judges to the Supreme Court, High Courts, and Federal Shariat Court and will also oversee the performance of High Court judges and prepare their annual performance evaluations.
Prior to the enactment of the 26th Constitutional Amendment, the JCP comprised a majority of judges. However, it now includes two members of the National Assembly, two members of the Senate, and one woman or non-Muslim member, to be nominated by the Speaker of the National Assembly.
As per the new legislation, the Judicial Commission of Pakistan will be headed by the chief justice of Pakistan and will also consist of three senior-most judges of the Supreme Court, the most senior judge of the constitutional bench, the Federal Minister for Law and Justice, the Attorney General for Pakistan, an advocate not having experience of less than 15 years of practice in the Supreme Court to be nominated by the Pakistan Bar Council (for two years).
