IHC says interim PM should quit if he can’t work in response to Baloch missing students case


The caretaker prime minister, interim defense minister, defense secretary, caretaker interior minister, and interior secretary should resign from their positions if they are unable to operate, according to remarks made on Monday by Justice Mohsin Akhtar Kayani of the Islamabad High Court.

As the case manager for the Baloch missing students, he made this statement.

Judge Kiani postponed the hearing till the next week and, on February 28, he personally called Anwaarul Haq Kakar, the acting prime minister.

The judge ordered Kakar to appear before him last week and gave him the opportunity to defend himself against any charges. Judge Kayani, who was hearing this case on November 29, cautioned that if the caretaker prime minister and others are unable to bring the missing Baloch students back to their families, then a case may be filed against them.

Hearing

Attorney General Mansoor Awan of Pakistan and Additional Attorney General Munawar Iqbal Dogal appeared in court on Monday alongside petitioner Imaan Mazari.

Judge Kiani enquired as to the status of the recovery efforts for the 12 missing Baloch pupils. AGP Awan stated that based on his knowledge, eight pupils have not yet fully recovered.

Regarding the interim ministries and secretaries, the judge inquired. It was the second time, he said, that the acting prime minister had skipped court. It was noted by Justice Kiani that this was the case’s 24th hearing.

Noting that this was the case’s 24th hearing, Justice Kiani further said that a petition had been submitted since 2022 and a commission had been established in response to it. The judge observed that although no criminal action was filed against “our citizens,” it took two years to recover them.

Furthermore, it stated that no records or information regarding the people who vanished during the previous two years had been given to the court. The IHC pointed out that individuals from the accused institution may have at least created a commission.

The judge noted that nothing has been done for the retrieval of the Baloch students despite the fact that one government controlled the court for more than three years, another for sixteen months, and then a caretaker government. This was in response to the AGP’s request for a stay in the case.  There have been accusations made against the institutions, he continued.

The PTI leader Sher Afzal Marwat told the court about a raid on his home on Sunday, the judge observed. He questioned the reason behind the Islamabad police’s 1:30 a.m. visit to Marwat’s home. The CTD head and the IGP from Islamabad were called by the court to the upcoming case hearing.

Justice Kiani instructed the AGP, “Tell the prime minister that don’t go to Karachi on the next hearing of the case.” The acting prime minister is not the permanent prime minister. Assure him that appearing in court is not improper. The court then postponed the hearing until February 28.
