The Peshawar High Court has sought responses from the federal government and other relevant authorities on a petition challenging the emergency notification and the imposition of emergency and Governor’s Rule in Khyber Pakhtunkhwa.
Barrister Gohar Ali Khan approached the court seeking suspension of the notification and challenging the measures taken in the province. A two-member bench headed by Justice Syed Arshad Ali heard the case and issued notices to the concerned authorities, directing them to submit their responses. The court adjourned further proceedings until November 3.
The hearing also covered petitions seeking the recovery of Khyber Pakhtunkhwa Chief Minister Sohail Afridi, Provincial Assembly Speaker Babar Saleem Swati, Junaid Akbar and others. The petitioners maintain that the individuals were taken into custody following the imposition of emergency and Governor’s Rule. They further claim that their whereabouts remain unknown.
The recovery petitions have brought questions about the individuals’ whereabouts and the circumstances surrounding their alleged detention before the court. The claims remain those of the petitioners, while the court has sought responses from the relevant authorities.
The legal challenge has also drawn a reaction from the legal community across the province. The Khyber Pakhtunkhwa Bar Council has described the measures as unconstitutional, while lawyers boycotted court proceedings across KP in protest.
The dispute comes amid calls for political cooperation at the national level. Federal Minister Rana Sanaullah has urged political parties and other stakeholders to unite against terrorism. He also said Prime Minister Shehbaz Sharif was willing to invite political parties for dialogue.
The court proceedings are scheduled to resume on November 3, when the responses from the federal government and other authorities will be relevant to the next stage of the case. The petitions challenge the legality of the measures and seek relief through the judicial process.
