Supreme Court Says Husband Cannot Claim Wife’s Gold or Wedding Gifts

ISLAMABAD: The Supreme Court of Pakistan has ruled that gold jewellery, bridal gifts and other valuables received by a woman at the time of marriage belong solely to her, confirming that neither her husband nor his family has any legal claim over them.

In its detailed judgment, the apex court stated that jewellery and gifts presented by the bride’s parents, relatives or friends remain her personal property. The court reiterated that, without her consent, these items may not be possessed, utilized or denied by the husband or his family.

A woman’s right of property is also violated when her jewellery is taken away and her personal belongings taken away is not protected under law, the ruling also said.

The Supreme Court also stated the intent of the donor is the determining factor in determining who owns a gift. Any object offered to the bride belongs to her unless there is strong proof to the contrary.

The judgment confirmed that Family Courts have full authority to hear cases related to the recovery of bridal jewellery, dowry and other personal belongings. Women who are denied access to their property can seek legal relief through the courts.

The decision was issued by a three-member bench headed by Chief Justice Yahya Afridi. The court dismissed the husband’s appeal and upheld the earlier decision of the Lahore High Court in favour of the woman.

Legal experts say the ruling strengthens the protection of women’s property rights and provides greater legal clarity in family disputes involving bridal gifts and jewellery.
